NOTICE: This Release Form is a contract with legal consequences. Read it carefully before signing.

I, the undersigned hereby freely agree to, and make the following contractual representations and agreements. I further understand completing this Release Form does not constitute membership in Orange Coast Velo (OCV).

I fully realize the dangers of participating in the sport of bicycle riding and fully assume the risks associated with such participation including by way of example, and limitation, the following: The dangers of collision with pedestrians, vehicles, other riders, and fixed or moving objects; the dangers arising from surface hazards, equipment failure, inadequate safety equipment, and weather conditions; and the possibility of serious physical and/or mental trauma or injury, including death, associated with athletic cycling competition.

I hereby waive, release and discharge for myself, my heirs, executors, administrators, legal representatives, assigns and successors in interest (hereinafter collectively “successors”) any and all rights and claims which I have or which may hereafter accrue to me against OCV, its sponsors, officers, directors and any other members who may be involved in organizing or leading club activities and training rides for any and all damages which may be sustained by me directly or indirectly in connection with any or arising out of my participation in or association with OCV or any races, training rides or other activities organized or promoted by OCV; including travel to or return from such activities.

I agree it is my sole responsibility to prepare adequately for participation in races and club activities, and to maintain my bicycle and equipment in proper working order. I understand and agree that situations may arise during races, training rides and other OCV events, which may be beyond the immediate control of OCV and the OCV members responsible for organizing such events, and I must continually ride so as to not endanger others or myself. I will participate in all races and training rides wearing a helmet, which satisfies the requirements or the USCF Racing Rules and that, can protect against serious head injury, and assume all responsibility and liability for the selection of such helmet. I have no physical or medical condition, which to my knowledge, would endanger others or myself if I participate in the sport of bicycle riding or would interfere with my ability to participate in the sport of bicycle riding.

I agree, for myself and successors, that the above representations are contractually binding, and are not mere recitals, and that should I or my successors assert my claim in contravention to this agreement, I or my successors shall be liable for the expenses (including legal fees) incurred by the other party or parties in defending unless the other party or parties are finally adjudged liable on such claim for willful and wanton negligence. This agreement may not be modified orally, and a waiver of any provision shall not be construed as a modification of any other provision herein or as consent to any other provision herein or as consent to any subsequent waiver or modification.
